Please read these Terms and Conditions ("Agreement", "Terms and Conditions") carefully before using www.onlinexfashion.com ("the Site") operated by OnlineXFashion ("us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.onlinexfashion.com.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing contents or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.
ONLINEXFASHION IS A VENUE
OnlineXFashion acts as a venue to allow both buyers and sellers, who comply with OnlineXFashion’s policies, to offer, sell and buy certain fashion goods within a fixed-price format. OnlineXFashion is not directly involved in the transactions between buyers and sellers, and has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. The completeness of a transaction between a buyer and seller cannot be ensured by OnlineXFashion.
Consequently, OnlineXFashion does not transfer legal ownership of items from the seller to the buyer.
OnlineXFashion cannot guarantee the true identity, age, and nationality of a user. OnlineXFashion encourages you to communicate directly with potential transaction partners through the tools available on the Site.
You agree that OnlineXFashion is a venue and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on OnlineXFashion. You use the OnlineXFashion service at your own risk.
LISTING AND SELLING
Listing Description: By listing an item on the Site you warrant that you and all aspects of the item comply with OnlineXFashion's published policies. You also warrant that you may legally sell the item. The information of the item such as the price, details of items and inventory amount, and all terms of sale in your listing must be described accurately. You may only include text descriptions, pictures and other content relevant to the sale of that item in your listing. All items must be listed in an appropriate category with appropriate tags.
Binding Sale: All sales are binding. The seller is obligated to ship the order or otherwise complete the transaction with the buyer in a prompt manner, unless there is an exceptional circumstance, such as: (a) the buyer fails to meet the terms of the seller's listing (such as payment method), or (b) the seller cannot authenticate the buyer's identity. The buyer is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance. Sellers shall bear all liabilities should the customer fail to receive the good(s) within the reasonable time frame.
Fee Avoidance: The price stated in each item listing description must be an accurate representation of the sale. Sellers may charge reasonable shipping and handling fees to cover the costs for packaging and posting the items. Sellers may not charge excessive shipping fees or otherwise avoid fees. You may not alter the item's price after a sale for the purpose of avoiding OnlineXFashion's transaction fees, misrepresent the item's location, or use another user's account without permission. Sellers may not encourage buyers to purchase an item listed on OnlineXFashion outside of the OnlineXFashion site, such as directly through email. This may also constitute fee avoidance.
RISK OF LOSS
Regardless of the method of shipment used, OnlineXFashion will not be liable for any lost/damaged parcels.
RETURNS AND EXCHANGES
All returns and exchanges are done on a case-by-case basis, based on the terms and conditions of each seller. Different seller might have different policy. Should there be any return details, they will be listed clearly in each seller's product listing page. Buyers have to carefully read through it.
RELEASE
If there is any dispute between the users (“buyer” or “seller”) of the Site, OnlineXFashion is released from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
INTELLECTUAL PROPERTY
The Site and its original content, features and functionality are owned by OnlineXFashion and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
TERMINATION
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
LINKS TO OTHER SITES
Our Site may contain links to third-party sites that are not owned or controlled by OnlineXFashion.
OnlineXFashion has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
GOVERNING LAW
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Malaysia, without giving effect to any principles of conflicts of law.
CHANGES TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
